Agreement & Important Arbitration Notice

These Terms of Service ("Terms") are an agreement between you and Your Transport Brokers, LLC ("Your Transport Brokers," "YTB," "we," "us"). They apply when you use yourtransportbrokers.com, request a quote, book a shipment, or otherwise use our services. By doing any of those things, you agree to these Terms. Section 17 requires most disputes to be resolved through individual binding arbitration and waives class actions and jury trials. Please read it carefully.

01

1. Who We Are

Your Transport Brokers, LLC is a property broker. We arrange the transportation of motor vehicles by independent motor carriers that hold their own federal operating authority. We are not a motor carrier. We do not own or operate trucks, employ drivers, or take possession of your vehicle at any time.

We operate under property broker authority issued by the Federal Motor Carrier Safety Administration (FMCSA): USDOT No. [USDOT NUMBER], MC No. [MC NUMBER]. You can verify our authority at safer.fmcsa.dot.gov ↗. Your Transport Brokers, LLC is a subsidiary of Your Logistics Brokers, Inc.

02

2. Our Role as Your Broker

When you book with us, we find a qualified carrier for your shipment, coordinate pickup and delivery, and stay in touch with you until your vehicle is delivered. The carrier performs the actual transportation.

  • •Before assigning a carrier, we check that it has active operating authority and cargo insurance on file with FMCSA.
  • •The carrier issues a Bill of Lading (BOL) at pickup. The BOL is the contract of carriage between you and the carrier and governs the transportation itself.
  • •Because carriers are independent businesses, we do not control how they operate. Except where the law provides otherwise, we are not responsible for a carrier's acts or omissions.
03

3. Quotes and Pricing

Your quote is based on the information you give us and on current carrier market rates for your route. It is valid for the period stated on the quote.

Your price may change if the information you provided is inaccurate or incomplete, or if you change the shipment. Common reasons include:

  • •The vehicle is inoperable (does not start, steer, and brake on its own) and this was not disclosed.
  • •The vehicle is modified, lifted, lowered, oversized, or carrying racks or accessories that were not disclosed.
  • •Pickup or delivery locations, dates, or the transport type (open or enclosed) change.

If your price needs to change before a carrier is assigned, we will tell you first, and you may cancel at no charge.

Your total price has two parts: the Broker Fee, which you pay to us, and the Carrier Fee, which you pay directly to the carrier.

04

4. Booking, Payment, and Fees

  • •No upfront payment. Requesting a quote or placing an order is free.
  • •Broker Fee. We charge the Broker Fee to your payment method only after a carrier has been assigned and has accepted your shipment. You authorize this charge when you book. We then send you a dispatch confirmation with the carrier's name and MC number, the pickup window, and the balance due at delivery.
  • •Carrier Fee. You pay the balance directly to the driver at delivery, before the vehicle is unloaded, using a payment method listed in your dispatch confirmation. These are typically cash, cashier's check, certified check, or money order. The carrier may hold the vehicle until it is paid.
  • •Other carrier charges. A carrier may charge additional fees it discloses to you, for example for a failed pickup ("dry run"), extended waiting time, storage when no one is available to accept delivery, or handling an inoperable vehicle that was not disclosed. You are responsible for these charges.
  • •Billing questions. If you believe a charge is wrong, please contact us first so we can resolve it quickly.
05

5. Pickup and Delivery Scheduling

  • •You give us the first date your vehicle is available for pickup. Pickup usually happens within a window that starts on that date. How long the window lasts depends on the route, season, and carrier availability.
  • •Pickup dates, delivery dates, and transit times are estimates, not guarantees, unless we confirm a guaranteed date in writing. Transit can be affected by weather, traffic, road conditions, mechanical problems, federal hours-of-service rules for drivers, and the carrier's other stops.
  • •The driver will usually contact you before arriving. Door-to-door service means the truck will get as close to your address as it legally and safely can. If a street is too narrow or restricted, you may need to meet the driver at a nearby safe location, such as a parking lot.
  • •Someone 18 or older must be present at pickup and at delivery with the keys. You may name a representative to release or receive the vehicle and sign the BOL for you.
  • •We are not responsible for rental cars, lodging, travel, lost wages, or other costs caused by a delay.
06

6. Preparing Your Vehicle

  • •Remove personal belongings. Auto carriers are not authorized to transport household goods, and their cargo insurance does not cover personal items. Standard equipment such as a spare tire and jack may stay. Anything else left in the vehicle is at your own risk, and the carrier may refuse it or charge for it.
  • •Leave about 1/4 tank of fuel or less.
  • •Turn off alarms. Remove or deactivate toll tags and parking passes. You are responsible for any toll charges made while your vehicle is in transit.
  • •Secure or remove loose exterior parts, custom accessories, and antennas, and fold in the mirrors.
  • •Wash the vehicle before pickup so the inspection is accurate.
  • •Tell us about any mechanical issues, fluid leaks, or problems with brakes or the battery. A carrier may refuse a vehicle that is leaking fluid or unsafe to load.
  • •Provide a set of keys for the ignition, trunk, and fuel cap.

By booking, you confirm that you are the vehicle's owner or are authorized by the owner to ship it, and that it contains no illegal, hazardous, or prohibited items.

07

7. Inspections and the Bill of Lading

  • •At pickup, the driver inspects the vehicle and records its condition on the BOL. Review it carefully, take your own date-stamped photos, and sign only if the BOL is accurate.
  • •At delivery, inspect the vehicle in good light before signing. Write any new damage on the BOL and have the driver sign next to it.
  • •Keep copies of both the pickup and delivery BOLs.
  • •Signing a delivery BOL with no damage noted is strong evidence that the vehicle arrived undamaged, and it can make a later claim very difficult to prove.
08

8. Damage, Loss, and Claims

Under federal law (the Carmack Amendment, 49 U.S.C. § 14706), the carrier is responsible for loss of or damage to your vehicle while it is in the carrier's possession, subject to the carrier's BOL and insurance. Because we are a broker and never take possession of your vehicle, YTB is not liable for loss or damage caused by a carrier. We will help you with the claim process, including giving you the carrier's contact and insurance details.

If your vehicle is damaged:

  • •Note the damage on the delivery BOL before you sign, and photograph it.
  • •Tell us within 24 hours of delivery so we can contact the carrier right away.
  • •Send a written claim to the carrier within the time allowed by law and the carrier's BOL. Federal law generally gives you at least nine months from delivery to file a written claim with a carrier.
  • •If you can, give the carrier or its insurer a chance to inspect the damage before you have it repaired.

Carrier terms commonly exclude damage noted at pickup, personal items, mechanical or electrical failures not caused by the carrier, and pre-existing conditions.

09

9. Cancellations and Refunds

  • •Before a carrier is assigned: you may cancel at any time at no charge.
  • •After a carrier is assigned: the Broker Fee is non-refundable, because the brokerage service of securing your carrier has been performed. Exception: if your vehicle is not picked up within 7 calendar days after the end of your confirmed pickup window, and the delay was not caused by you, you may cancel for a full refund of the Broker Fee.
  • •If you cancel after the carrier is already on the way, or if the vehicle is unavailable or not as described when the driver arrives, the carrier may charge a dry-run fee.
  • •Approved refunds are issued to your original payment method, usually within 10 business days.
10

10. A Carrier's Right to Refuse

A carrier may refuse to load a vehicle that is unsafe, not as described, carrying personal or prohibited items, or not accessible for pickup. If a refusal is caused by inaccurate information or by a failure to follow Section 6, the Broker Fee is not refundable, and any carrier charges remain your responsibility.

11

11. Calls, Text Messages, and Email

When you give us your phone number, you agree that we, and the carrier assigned to your shipment, may call and text you at that number about your quote, booking, dispatch, pickup, delivery, and customer service. These calls and texts may use automated technology.

We will send you marketing calls or texts only if you have given us your prior express written consent. Giving that consent is not a condition of any purchase.

  • •Message frequency varies. Message and data rates may apply.
  • •Reply STOP to any text to stop receiving texts, or HELP for help. You can also opt out by calling or emailing us.
  • •If you opt out of texts during an active shipment, we may still contact you by phone or email about that shipment.
  • •You confirm that the number you give us is yours or that you are authorized to use it. Please tell us if it changes.
12

12. Electronic Communications and Signatures

You agree that we may give you notices, confirmations, and documents electronically, and that electronic signatures and click-through acceptances are as binding as signatures on paper.

13

13. Use of This Website

You agree to provide accurate information and to use this website only for lawful purposes. You may not interfere with the site, attempt to access non-public areas, or copy its content for commercial use. The site's content, logos, and design belong to YTB or its licensors. Shipment status information and links to third-party websites are provided for convenience only.

14

14. Disclaimers

This website and its content are provided "as is." To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability and fitness for a particular purpose. Quotes, estimated dates, and transit times are estimates.

15

15. Limitation of Liability

To the fullest extent permitted by law, YTB will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, rental or travel costs, or loss of use. YTB's total liability for any claim arising from these Terms or our services is limited to the Broker Fee you paid us for the shipment involved. Nothing in these Terms limits any liability that cannot be limited by law, or a carrier's own liability under federal law.

16

16. Indemnification

You agree to indemnify and hold harmless YTB, its parent company, and their officers, employees, and agents from claims, losses, and expenses, including reasonable attorneys' fees, arising from inaccurate information you provide, items left in the vehicle, your breach of these Terms, or your violation of any law.

17

17. Dispute Resolution, Binding Arbitration, and Class Action Waiver

  • •Informal resolution first. Before starting arbitration or a lawsuit, you and we agree to try to resolve the dispute informally. The party with the dispute must send the other a written notice describing it. If you are sending the notice, email it to info@yourtransportbrokers.com or mail it to our address below. If the dispute is not resolved within 30 days of the notice, either party may start arbitration.
  • •Binding arbitration. Any dispute arising from these Terms, our services, or this website will be resolved by binding arbitration on an individual basis. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and the Federal Arbitration Act governs this agreement to arbitrate. Arbitration hearings will take place in Lee County, Florida, or by phone or video, or on written submissions if the arbitrator allows. Filing, administration, and arbitrator fees will be paid as set out in the AAA Consumer Arbitration Rules.
  • •Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may also seek court relief to stop infringement of intellectual property.
  • •Class action and jury trial waiver. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not combine claims of more than one person. You and we each waive the right to a jury trial.
  • •30-day opt-out. You may opt out of this arbitration agreement within 30 days after you first agree to these Terms. To do so, email info@yourtransportbrokers.com with the subject line "Arbitration Opt-Out" and include your name, phone number, and email address.

If the class action waiver is found unenforceable for a particular claim, that claim will not be arbitrated and will be resolved in the courts described in Section 18. This section survives the end of your relationship with us.

18

18. Governing Law and Venue

Federal law, including Title 49 of the United States Code, governs the transportation and brokerage matters it covers. Otherwise, these Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any claim that is not subject to arbitration will be brought only in the state or federal courts located in Lee County, Florida, and you consent to their jurisdiction.

19

19. Events Beyond Our Control

We are not responsible for delays or failures caused by events beyond our reasonable control. These include severe weather, natural disasters, road closures, accidents, fuel shortages, labor disputes, government actions, public health emergencies, and failures of utilities or communications networks.

20

20. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and change the "Last Updated" date. The Terms in effect when you book a shipment apply to that shipment.

21

21. General

These Terms, your dispatch confirmation, and the carrier's Bill of Lading make up the entire agreement about your shipment. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our written consent.
